About these Terms

EliteScout Football is operated by EliteScout Football, based in New South Wales, Australia. These Terms form a binding agreement between you and us. They should be read together with our Community Guidelines and our Privacy Policy, which are incorporated by reference.

Eligibility

You must be at least 13 years old to use EliteScout Football. By using the service you confirm that you meet this requirement and that the information you provide when creating an account is accurate and kept up to date.

Your account

You are responsible for your account and for keeping your login details secure. You are responsible for all activity that occurs under your account. Please contact us promptly if you believe your account has been accessed without your authorisation.

The service

EliteScout Football is a fantasy football game. During the current launch period the service is provided free of charge. We may add, change, suspend, or remove features at any time, and we may set or change limits on the use of certain features. We do not guarantee that the service will be available without interruption or free of errors.

Acceptable use

When using EliteScout Football, you must comply with our Community Guidelines. In addition, you must not:

• use the service for any unlawful purpose or in breach of these Terms;
• attempt to gain unauthorised access to the service, other users' accounts, or our systems;
• interfere with, disrupt, or place undue load on the service or its infrastructure;
• scrape, copy, or harvest data from the service except as expressly permitted;
• manipulate, cheat, or exploit the game mechanics, scoring, or leagues; or
• create or use multiple accounts to gain an unfair advantage.

Content you post

You are responsible for any content you post through the service, including messages and team names ("User Content"). You retain ownership of your User Content, but you grant us a non-exclusive, royalty-free licence to host, store, and display it for the purpose of operating the service.

We may remove any User Content and suspend or terminate any account that breaches these Terms or our Community Guidelines, as described in those documents.

Our intellectual property

EliteScout Football, including its software, design, branding, and original content, is owned by us or our licensors and is protected by intellectual property laws. You may use the service for your own personal, non-commercial use only. You may not copy, modify, distribute, or create derivative works from the service without our permission, except as allowed by law.

Premier League and third-party data

EliteScout Football is an independent product. It is not affiliated with, endorsed by, or sponsored by the Premier League, any football club, or any player. References to the Premier League, clubs, and players are used for descriptive purposes only.

Player statistics and other data are sourced from third-party providers and are made available on an "as is" basis. We do not warrant that this data is accurate, complete, or current, and you should not rely on it for any betting, gambling, or other financial purpose.

Disclaimers

To the maximum extent permitted by law, EliteScout Football is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the service will meet your requirements, be uninterrupted, secure, or error-free, or that any data or results obtained through it will be accurate or reliable.

Limitation of liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded or limited.

Subject to the paragraph above, to the maximum extent permitted by law: we are not liable for any indirect, incidental, special, or consequential loss arising out of or in connection with your use of the service; and where our liability can be limited, it is limited, at our option, to resupplying the service or paying the cost of having the service resupplied.

Suspension and termination

We may suspend or terminate your access to EliteScout Football at any time, with or without notice, if you breach these Terms or our Community Guidelines, or where we reasonably consider it necessary to protect the service or other users. You may stop using the service and delete your account at any time.

Changes to these Terms

We may update these Terms from time to time. We will indicate the date of the most recent change above and, where appropriate, notify you within the service. Your continued use of EliteScout Football after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.
